Dr. Baruch Falach Auction
The auction house “Dr. Baruch Falach Auction” will open during 2017 as additional department in the store of books and Judaica.
At the auction house we will offer different items that we purchase: Books, posters, postcards, albums, manuscripts, etc. The idea behind setting up a auction house is to give equal opportunity to all buyers to compete for the items that we purchase.
Terms of sale
- The commission of the auction is 20%.
- There is no added VAT on the commission, the VAT is a part of the commission.
- The payment is made up to 7 days from the date of sale. You can pay by cash, credit, bank transfer or paypal. Payment on paypal involves a commission of 5%.
- We do not charge a fee for payment by a credit card!!
- Payment by check will be accepted only from old and recognized customers and according of the auction house manager.
- The item will remain in the auction house until the complete payment.
- The relevant dollar rate is the rate of the day of sale only, whether the dollar rose or fell later relative to the shekel.
- A payment after 7 days will result in a 1% commission on each day of late.
- If the buyer does not release the item, the auction house may take all of the procedures at its disposal without prior notice to the purchaser.
- The sale will be conducted in US dollars, the payment is in shekels or dollars.
- As stated in Section 11, the calculation of the payment in dollars will be subjected to the ratio between the exchange rate of the dollar and the shekel on the day of sale.
- A customer who’s requesting delivery, will pay the entire shipping cost and insurance if he wishes to insure the item. The method of shipment will be executed the customer wish and it will be at his own risk.
- The auction house reserves the right to cancel or add items for sale, or change data regarding items offered that were received after the catalog published.
- The auction house will have the exclusive authority to decide who is entitled to participate in the sale and / or who won the sale and / or cancel the sale of any work altogether and / or add an item for sale and / or to place any item for resale and / For the item offered for sale, at its sole and absolute discretion.
- For each auction, the auction house will display an online catalog detailing the known data about each item (hereinafter: “the auction catalog”). The data presented in the sales catalog will include, among other things, the list of items offered for sale, their serial numbers in the auction, the producers of the items, the production technique, the valuation of the items, photographing items and other details about items as far as these are known to the “sales house”.
- Participation in the auction is conditional upon registration of the participant ahead and with the approval of Dr. Baruch Falach, the owner of the auction house.
- The items are sold “AS-IS”. The auction house will provide any information regarding any item or work displayed for sale including condition, size and any defect if it exists to the best of its professional judgment. All of the items that displayed in the auction will be displayed ahead to the public and the person who’s interested will consider by examining the items by himself, (the person may come physically to the auction house to check closely) and with the submission of an early offer or online offer at the time of sale or before or by telephone participation, then hereby waives interest in any claims regarding the quality or condition of the item, financial assessment or any other claim.
- Whether the Purchaser has offered its offer in writing, by telephone, or through a website, whether for itself or any third party, it shall be liable for irrevocable undertaking to receive the item and to pay for it.
- The customer has the right to return the item and receive back the amount paid for the purchase minus 10% if he proves that the item is counterfeit or does not stand against its definition. (The customer will not be credited for the payment he paid as a commission).
- All of the provisions of this Agreement in the singular also refer to the language of many or a corporation or a LTD company and on a contrary.
- The sole and exclusive jurisdiction in any dispute regarding this agreement between “Dr. Baruch Falach auction” and the purchaser will be vested in the courts in Netanya.
- The Hebrew text of the catalog is the correct version, and overrides any addition, omission or change in the English translation.
